Terms and Conditions

IGIFTWINE Pty Ltd (ACN 49 602 362 523), trading as iGiftWine (IGIFTWINE) TERMS and CONDITIONS

1.     Ordering and liquor laws

IGIFTWINE holds a Packaged Sales Licence under the NEW SOUTH WALES Liquor Licensing Act 1997, License number LIQP770016830.  IGIFTWINE is required to ensure an audit trail exists to identify the purchase and sale or supply of liquor and no liquor is to be sold or supplied to a minor.

It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.

You must be over 18 years of age to purchase from IGIFTWINE.  We ask you to enter your date of birth and agree to our Terms and Conditions and by doing that you confirm you over 18 years of age.  If you do not confirm that you are over 18 years of age, your order will not be processed.

2.     Content

All content on this site including but not limited to text, graphics, logos, icons images and software, is the property of IGIFTWINE.  Any improper use including reproduction, modification, distribution, transmission, republication or display of the content on this website is strictly prohibited.

3.     Disclaimer about prices

All prices quoted on this site are subject to change without notice due to market and currency fluctuations, changes in duty, GST and other government charges and stock levels.

Whilst every effort is made to ensure that all vintages are current, due to the nature of the industry, vintages may change suddenly depending on supply and stockholdings of the producer.  If the stocked vintage changes before you receive your order, where possible, we will contact you to inform you of the change to the vintage and determine if you still want the product.

4.     Delivery and Returns

We use the specialized wine delivery network at Australia Post to deliver your wine. This service requires a signature upon delivery for security purposes.  If you choose to have the wine delivered to your home or business and you are out when the delivery is attempted, a card will be placed in your letterbox and your package will be securely stored at your local post office for collection. The post office keeps your parcel for a maximum of 14 days.

Alternatively, during the checkout process you can elect to have your wine left at the delivery address in a specific location ie, under the verandah, behind the side gate, in the dog kennel etc, if no one is home.  Doing so removes the requirement for a signature and passes to you the risk of any issues that may occur after the wine is delivered; ie, wine gets damaged by inclement weather, some bozo flogs it, etc.

Delivery can take up to 10 working days, but this time frame can be shorter depending on the overall pressure on the delivery network at that particular time, your distance from major centres and product availability.

Claims for broken or damaged goods must be reported within 24 hours of delivery, so make sure you check your order as soon as you receive it.

If for any reason you are not satisfied with your order, you can return it to us, with an explanation as to why you returned the wine.  We will give you a credit for the returned items, minus any delivery charges

Requests for returns for credit or exchange must be made within 7 days of receiving your wine.

5.     Correspondence

By placing an order with us you agree to receive correspondence from us including but not limited to information as it relates to your purchase(s) along with promotional material as we see fit to conduct the normal course of our business.  In the case of promotional correspondence, you can unsubscribe from this at any time

This enables us to process your order.  We also require your telephone number to notify you of your orders status if required and your date of birth for licensing purposes – obviously we can’t sell booze to minors so we have to be sure.  We will also use this information to contact you (unless you tell us not to) to keep you abreast of special offers and promotions we have available.

From time to time, we may also collect sales history and purchase preference data, for example, that helps us in our ongoing efforts to improve our web site and to make informed decisions when providing information on items you may wish to know about.

We collect information when you place orders with us online or contact us by telephone. If someone purchases you a gift for, your information may become available to us from a third party.  We will ensure that the source of your information is indicated clearly in our customer list so you can confirm how we collected it if required.  Personal information we hold is generally stored in computer systems.  In all cases, we have rigorous security mechanisms to reduce the risk of unauthorised access to, loss, misuse or wrongful changes to, personal information.

We may also, from time to time, use third party experts, such as Australia Post in relation to addressing, to ensure that our information is accurate and as up to date as possible.

Why do we collect, hold, use and disclose personal information?

We collect and use your personal information to sell and promote our goods and services to you and to improve on the range of our wines and our services.

We only use or disclose information about our customers in ways they would reasonably expect.  This means we only use information to process your order or to improve our website and offers and range of goods and services.  At this time we do not partner with or have special relationships with any third parties and do not pass your personal information to any third parties.

Complaints

Sharing of your personal information overseas

We may make a business decision to store our data with a service provider, for example a cloud service provider who is in the business of providing data storage and processing services.  These services often use different locations around the world that might change from time to time.  Where we use such services, it is not practical for us to tell you which country your personal information may be located in.  We will ensure that any service providers observe privacy and security standards like we observe her in Australia.

This privacy policy is current at 10 September 2015. If we change the policy we will publish the new policy on our website.   More information about privacy law and privacy principles is available from the Privacy Commissioner.
